\u00bfD\u00f3nde se registran las marcas?\u00a0 Esta es una pregunta que me hacen frecuentemente.\u00a0 Como suele suceder en temas legales, la respuesta es m\u00e1s complicada de lo que parece.<\/p>\n\n\n\n

El derecho aplicable sobre las patentes, derechos de autor y marcas, entre otras cosas, es jurisdiccional.\u00a0 Esto significa que cada pa\u00eds tendr\u00e1 leyes particulares al respecto, y la protecci\u00f3n brindada estar\u00e1 limitada a su demarcaci\u00f3n territorial. Es por esto que las marcas<\/a>, al igual que otros tipos de propiedad intelectual<\/a>, se deben registrar en el pa\u00eds o pa\u00edses donde se quieren proteger.\u00a0<\/p>\n\n\n\n

Entonces, \u00bfd\u00f3nde se registran las marcas?\u00a0 Para responder adecuadamente a esta pregunta, hay que considerar otras preguntas.\u00a0 Todas las cuales ejercen influencia al momento de decidir donde registrar la marca.\u00a0 Por ejemplo, debemos pensar en:<\/p>\n\n\n\n

  1. \u00bfD\u00f3nde se ofrecen los servicios?<\/li>
  2. \u00bfD\u00f3nde residen las personas que reciben el servicio?<\/li>
  3. \u00bfD\u00f3nde se vende o vender\u00e1 el producto?<\/li>
  4. \u00bfD\u00f3nde se manufactura o manufacturar\u00e1 el producto?<\/li>
  5. \u00bfDe ser exitoso, cu\u00e1les son los pr\u00f3ximos mercados?<\/li><\/ol>\n\n\n\n

    Todas estas preguntas, y sus respuestas, est\u00e1n directamente relacionadas con el desarrollo y crecimiento empresarial.\u00a0 Por esto, es importante incorporar la propiedad intelectual dentro de la estrategia del desarrollo empresarial.<\/p>\n\n\n\n

    \u00bfD\u00f3nde se registran las marcas?<\/h2>\n\n\n\n

    En los Estados Unidos y sus territorios, las marcas se pueden registrar a nivel estatal, con el Departamento de Estado, y\/o a nivel federal en la Oficina de Patentes y Marca de los Estados Unidos, conocida por sus siglas en ingl\u00e9s como el USPTO<\/a>.\u00a0 S\u00ed, la marca se puede registrar a nivel estatal y federal.\u00a0 Ambos registros brindan beneficios, y uno no necesariamente es mejor que el otro.\u00a0<\/p>\n\n\n\n

    Donde hacerlo es cuesti\u00f3n de estrategia.\u00a0 Lo bueno de las marcas, es que no hay que realizar todos los posibles registros a la vez o dentro de un tiempo limitado.\u00a0 Las solicitudes se pueden presentar poco a poco y seg\u00fan el presupuesto lo permita.<\/p>\n\n\n\n
