\u00bfQu\u00e9 es el Trademark Modernization Act<\/a><\/em>?\u00a0 El 27 de diciembre de 2020, el Trademark Modernization Act<\/em> tambi\u00e9n conocido como el Trademark Act of 2020<\/em>, se convirti\u00f3 en ley.\u00a0 Esta nueva ley, trae varios cambios a la ley de marcas federal, conocida como el Lanham Act<\/a><\/em>.<\/p>\n\n\n\n

El Trademark Modernization Act<\/em>, al igual que el CASE Act<\/a>,<\/em> fueron aprobadas por el Congreso de los Estados Unidos como parte de medidas de est\u00edmulo.\u00a0<\/p>\n\n\n\n

\u00bfQu\u00e9 cambios trae el TM Act of 2020?<\/em><\/h4>\n\n\n\n

Esta nueva ley, busca modificar ciertos aspectos procesales.\u00a0 Con estos cambios, se busca:<\/p>\n\n\n\n

  1. Clarificar y establecer uniformidad sobre el peso de la prueba requerido para obtener un remedio interdictal o injunction<\/em> en un litigio de marcas;<\/li>
  2. Establecer dos procesos nuevos para la cancelaci\u00f3n de marcas en desuso o fraudulentas; y<\/li>
  3. Permitir a los oficiales examinadores acortar el t\u00e9rmino habido para responder a las acciones administrativas; entre otras cosas.<\/li><\/ol>\n\n\n\n

    <\/p>\n\n\n\n

    La presunci\u00f3n de un da\u00f1o irreparable.<\/h4>\n\n\n\n

    A trav\u00e9s de los cambios presentados en esta nueva ley, se establece una presunci\u00f3n de da\u00f1o irreparable al solicitar un remedio interdictal en los litigios de violaci\u00f3n al derecho marcario al demostrar una violaci\u00f3n a la marca.\u00a0 Con esto se pone fin a la divisi\u00f3n habida entre los tribunales al respecto.\u00a0 Divisi\u00f3n la cual hab\u00eda sido palpable desde la decisi\u00f3n del Tribunal Supremo de los Estados Unidos en el caso de eBay Inc. v. MercExchange, 547 U.S. 388 (2006)<\/a><\/em>.<\/p>\n\n\n\n

    Procesos nuevos para solicitar la cancelaci\u00f3n de una marca.<\/h4>\n\n\n\n

    La Oficina de Marcas de los Estados Unidos ha visto un aumento en el n\u00famero de solicitudes internacionales.\u00a0 Algunas de estas con informaci\u00f3n fraudulenta o falsificada.<\/p>\n\n\n\n

    Estos nuevos procesos permiten:<\/p>\n\n\n\n

    1. Retar el registro de una marca que no ha sido adecuadamente utilizada en el comercio, y<\/li>
    2. Retar el registro de una marca que no fue utilizada en el comercio con anterioridad a la fecha de registro.<\/li><\/ol>\n\n\n\n

      <\/p>\n\n\n\n

      Acortar el t\u00e9rmino para responder a una acci\u00f3n administrativa.<\/h4>\n\n\n\n

      Como regla general, las personas tienen seis meses para responder a las notificaciones o acciones administrativas emitidas por los oficiales examinadores de la Oficina de Marcas de los Estados Unidos.\u00a0 Los cambios surgidos por medio del Trademark Act of 2020<\/em>, les concede a los oficiales examinadores acortar este t\u00e9rmino.<\/p>\n\n\n\n

      \u00bfQu\u00e9 significa esto?<\/h4>\n\n\n\n

      En adici\u00f3n a ponerle fin a una diferencia de opini\u00f3n entre los tribunales federales, estos cambios empoderan a los due\u00f1os de marcas con procesos m\u00e1s agiles y herramientas con las cuales combatir marcas fraudulentas.<\/p>\n\n\n\n
